Judicial review of Immigration and Refugee Board, Refugee Protection Division (RPD) decision dismissing application under Refugee Protection Division Rules, SOR/2002-228, s. 55(4) to have application for refugee status reopened—That application filed after RPD deciding claim for refugee status abandoned—Pursuant to s. 55(4), application to reopen must be granted if principle of natural justice breached—RPD not considering letter before it from refugee centre assisting applicant acknowledging responsibility for late filing of Personal Information Forms, requesting extension of time—Failure to consider letter resulting in breach of natural justice as applicant not given opportunity to be heard—Application allowed.
