Whether expunged portions of memoranda protected by solicitor-client privilege--In Lumonics Research Limited v. Gould, [1983] 2 F.C. 360 (C.A.), F.C.A. made it clear onus of establishing facts relevant to claim of privilege on party opposing production of documents by reason thereof--Respondents herein have not met onus as failed to adduce any evidence to establish facts giving rise to privilege claimed--Clear from K.F. Evans Ltd. v. Canada (Minister of Foreign Affairs) (1996), 106 F.T.R. 210 (F.C.T.D.) and Lumonics that affidavit setting forth relevant circumstances necessary to establish claim of privilege--As respondents herein have filed no affidavit setting forth relevant facts and circumstances, impossible to decide whether expunged portions of memoranda subject to solicitor-client privilege--As burden of proof on respondents, applicant succeeds on motion and expunged portions will have to be produced by respondents within 10 days of order.
